Fundamental Rights


  • The idea of fundamental rights has been taken from US Constitution
  • Part III ,Article 12 - 35
  • Sardar Vallabhai Patel is the chief  architect of fundamental rights.
  • Fundamental rights are justiciable
  • 6 fundamental rights : Right to equality (Article 14-18)
    Right to freedom (Article 19-22)
    Right against exploitation (Article 23-24)
    Right to freedom of religion (Article 25-28)
    Cultural and Educational rights (Article 29-30)
    Right to constitutional remedies (Article 32) - guarantees all the fundamental rights
  • Originally Constitution contains 7 Fundamental Rights but Right to property (Article 31 , Article 19f) is removed through Amendment 44 . Right to Property is now a legal Right
  • Part III  is known as Magna Carta of India
  • Article 32 is called Heart and Soul of Indian Constitution by Dr. B R Ambedkar
  • The authority to issue writs for the enforcement of fundamental Rights is the Supreme Court
  • In India Supreme Court (Article 32 ) and High Court  (Article 226) has the power to issue Writs
  • Five types of Writs - Habeas Corpus, Mandamus, Prohibition, Certiorari and Quo warranto.
  • Habeas Corpus literally means ‘to have the body of’. The court can cause any person who has been imprisoned to be physically brought before the court (അന്യായമായി തടവിലാക്കപ്പെട്ട ഒരു വ്യക്തിയെ വിടുവിക്കുവാൻ ഉപയോഗിക്കുന്ന ഒരു റിട്ടാണിത്)
  • Mandamus means “we command”. This writ is a command issued by court to a public official, public body, corporation, inferior court, tribunal or government asking them to perform their duties which they have refused to perform
  • The writ of prohibition means that the Supreme Court and High Courts may prohibit the lower courts who are doing something which exceeds to their jurisdiction (സുപ്രീം കോടതിയും, ഹൈക്കോടതികളും കീഴ്ക്കോടതികൾക്ക് നൽകുന്ന നിരോധന ഉത്തരവുകളാണ്)
  • Certiorari means to “certify”.A writ of certiorari orders a lower court to deliver its record in a case so that the higher court may review it.
  • Quo warranto means “by what warrant”? This writ is issued to enquire into legality of the claim of a person or public office (നിയമപരമായി തനിക്ക് അവകാശമില്ലാത്ത ഒരു സ്ഥാനത്തോ പദവിയിലോ ഒരാൾ കയറിപ്പറ്റുകയോ ഇല്ലാത്ത അധികാരം പ്രയോഗിക്കുകയോ ചെയ്താൽ അതിൽ പരാതിയുള്ള ഏതൊരു വ്യക്തിക്കും ക്വോ വാറന്റോ ഹർജി കോടതിയിൽ സമർപ്പിക്കാവുന്നതാണ്.)
