- The power to amendment the constitution rests in Parliament (Article 368)
- Bill can be initiated only in either house of parliament and not in state legislature.
- The constitution can be amended in three ways:
1. Amendment by simple majority of the parliament - an easy method of amendment by passing as a law in the normal way. Formation of new States and alteration of areas, boundaries or names of existing States, Citizenship etc
2. Amendment by special majority of the parliament - more than 50% of the total membership of each House and a majority of two-thirds of the members of each House present and voting. Fundamental Rights,
Directive Principles of State Policy etc..
3. Amendment by special majority of the parliament and the ratification of half of the state legislatures - special majority of the Parliament with the consent of half of the state legislatures by a simple majority. When half of the states give their consent, bill gets finally passed. Election of the President , Supreme Court and high courts,Power of Parliament to amend the Constitution etc . - Signature of the President is required as the final to transform amendment bill into an Amendment Act
